Now the period for applying for indexation of awarded amounts will be limited to one year.
President Vladimir Putin signed Law No. 54, which defines the maximum time limits for indexation of a foreclosed debt. It is aimed at implementing the Constitutional Court Resolution of 20.06.2024 No. 31-P. The constitutional control body then explained that the current version allows for arbitrarily determining the time limits for the claimant to apply to the court for indexation of awarded money.
Now such an application can be submitted within a period not exceeding one year. This will eliminate uncertainty and help discipline the parties to the process, they explained in the explanatory note to the draft. Changes were made to both arbitration and civil proceedings, as well as to administrative proceedings (Article 183 of the Arbitration Procedure Code, 208 of the Civil Procedure Code and 189.1 of the Code of Administrative Procedure).
The established time limits begin to run from the day the debtor executes the judicial act. In addition, the court can restore them if the omission occurred for a valid reason.
The law will come into force on April 12.
